{"id":11968,"date":"2023-11-10T01:54:25","date_gmt":"2023-11-10T01:54:25","guid":{"rendered":"https:\/\/infundpros.com\/business\/apple-dealt-blow-at-top-eu-court-over-e14-3bn-tax-bill-in-ireland\/"},"modified":"2023-11-10T01:54:25","modified_gmt":"2023-11-10T01:54:25","slug":"apple-dealt-blow-at-top-eu-court-over-e14-3bn-tax-bill-in-ireland","status":"publish","type":"post","link":"https:\/\/infundpros.com\/?p=11968","title":{"rendered":"Apple dealt blow at top EU court over \u20ac14.3bn tax bill in Ireland"},"content":{"rendered":"<div>\n<p>Unlock the Editor\u2019s Digest for free<\/p>\n<p class=\"article__content-sign-up-topic-description\"><span>Roula Khalaf, Editor of the FT, selects her favourite stories in this weekly newsletter.<\/span><\/p>\n<p><iframe class=\"article__content-sign-up-iframe close\" scrolling=\"no\" id=\"signUpIframe\" data-prev-url=\"\/register\/in-article-sign-up?ft-content-uuid=db2e63a1-9972-444f-9ae3-70bec32b020b\"><\/iframe><\/div>\n<div id=\"article-body\">\n<p>Apple has been dealt a blow in its \u20ac14.3bn tax dispute with Brussels after an adviser to the EU\u2019s top court said an earlier ruling over its business in Ireland should be shelved.<\/p>\n<p>Giovanni Pitruzzella, advocate-general of the European Court of Justice, the EU\u2019s highest court, said on Thursday that a landmark decision quashing the EU\u2019s order for Apple to pay \u20ac14.3bn in back taxes to Ireland \u201cshould be set aside\u201d.<\/p>\n<p>Such opinions by advocates-general are non-binding but often influential in final judgments by the EU\u2019s top court.<\/p>\n<p>The General Court, the EU\u2019s second-highest court, ruled in 2020 that, while it supported the EU\u2019s right to investigate national tax arrangements, Brussels had failed to show that Apple had received an illegal economic advantage in Ireland over tax.<\/p>\n<p>But Pitruzzella said the court had \u201ccommitted a series of errors in law\u201d and \u201cfailed to assess correctly the substance and consequences of certain methodological errors\u201d. As a result, he said the court needed \u201cto carry out a new assessment\u201d.<\/p>\n<p>An ECJ ruling is expected next year.<\/p>\n<p>Competition commissioner Margrethe Vestager said in 2016 that Apple\u2019s tax arrangements in effect gave the tech giant a tax rate of less than 1 per cent and an unfair edge over rivals, violating the bloc\u2019s state-aid rules.<\/p>\n<p>Ireland collected \u20ac14.3bn in contested back taxes and interest from the company in 2018 \u2014 funds that have since been held in an escrow account as the legal process continues.<\/p>\n<p>Aidan Regan, an associate professor of political economy at University College Dublin and an expert on Irish corporation tax, said the commission\u2019s argument was that Ireland in effect \u201cgave Apple unfair advantage in the market because they could accumulate so much profit tax free for such a long period of time\u201d.<\/p>\n<p>Apple said the General Court\u2019s ruling \u201cwas very clear that Apple received no selective advantage and no state aid, and we believe that should be upheld\u201d.<\/p>\n<p>Ireland on Thursday also insisted the company had been given no preferential treatment.<\/p>\n<p>\u201cIt has always been, and remains, Ireland\u2019s position that the correct amount of Irish tax was paid and that Ireland provided no state aid to Apple,\u201d finance minister Michael McGrath said in a statement.<\/p>\n<p>The opinion shines a light on Ireland\u2019s long-held policy of keeping corporation tax low as a driver of investment. Its 12.5 per cent tax rate helped attract global tech and pharmaceutical companies and has led to bumper returns. The country\u2019s corporation tax receipts have more than tripled in the past eight years to a record of \u20ac22.6bn last year.<\/p>\n<p>Ireland is now setting up a sovereign wealth fund to save windfall tax proceeds, but as the country prepares in January to increase its corporation tax rate to 15 per cent under an OECD deal, corporation tax receipts have fallen sharply for each of the past three months.<\/p>\n<p>Any ECJ ruling in favour of paying the money to the Irish exchequer is likely to prompt calls from other EU states and the US to claim part of any payment, Regan said.<\/p>\n<p>The commission said it did not comment on the opinions given by advocates-general. <\/p>\n<p>The Apple case is part of a wider clampdown launched by Brussels in 2013 against alleged sweetheart tax deals in member states.<\/p>\n<p>The commission has also had legal difficulties with other parts of its tax deal clampdown. Brussels is appealing against a General Court decision overturning an order for Amazon to pay back taxes in Luxembourg.<\/p>\n<p>In addition, the commission lost a similar case over the Netherlands\u2019 tax deals with Starbucks but has not filed an appeal.<\/p>\n<p>Vestager is on a leave of absence as she makes a bid to head the European Investment Bank.<\/p>\n<p>She said on X, formerly Twitter: \u201cAll companies should pay their fair share of tax.
